The State of Illinois has enacted the Child Passenger Protection Act. This legislation states that children under the age of eight (8) years must be secured in an appropriate car seat such as rear-facing only for infants, forward-facing with a harness for toddlers, and booster seats that are used with the vehicle lap and shoulder belt system. It also states that the parent or legal guardian of a child under the age of eight (8) is responsible for providing a child safety seat or booster seat to anyone who transports his or her child.

As of January 1, 2019, the Act also requires that children remain rear-facing until at least age two (2).

If a person receives a citation for being out of compliance with the Child Passenger Safety Act, there is a fine of $75.00 for the first offense. The person may have the citation dropped if they can prove in court that they met with a certified Child Passenger Safety Technician to receive instruction on the installation of a car seat/booster seat or that they have obtained possession of an appropriate car seat for their child.

The Illinois Department of Transportation offers a Child Restraint Citation Compliance Inspection form BSPE 1000. This form is approved as proof in court that the person whom obtained the citation met with a CPS Technician for educational information or a car seat, whichever the case may be. The Child Passenger Safety Technician must document education provided during the appointment on the form.

The form is available as two-part carbon copies and will soon be only available electronically. The white copy is for the technician to keep. The yellow copy is for the parent or caregiver to take to court. If a person calls you to set up this type of appointment, also require they bring the child and a copy of the citation with them to the appointment. You will need it to complete all fields.
